Description
Fungi containing psilocybin, a prototypical psychedelic with similar effects to LSD, but with a shorter duration; also considered as being more confusing, introspective and entheogenic. Usually refers to psilocybe mushrooms rather than Amanitas, which have different effects. Are considered physically safe if properly identified, which should always be done by an expert.

Tramadol is well known to lower seizure threshold and psychedelics also cause occasional seizures.
Cannabis has an unexpectedly strong and somewhat unpredictable synergy with psychedelics.
Stimulants increase anxiety levels and the risk of thought loops which can lead to negative experiences

DE Germany Illegal
Illegal. Psilocybin/psilocin are in Anlage I of the BtMG.
German law strictly prohibits psilocybin. Fresh mushrooms were explicitly banned following EU-wide crackdowns in the 2000s.
CH Switzerland Illegal
Illegal for recreational use. Limited medical trials ongoing.
While recreational use is illegal, Switzerland has authorized compassionate use for psilocybin-assisted therapy for depression.
GB United Kingdom Illegal
Class A controlled substance. Illegal since 2005.
Before 2005, fresh magic mushrooms were legal in the UK due to a loophole. The Drugs Act 2005 closed this.
FR France Illegal
Illegal for all purposes. Stupéfiant (narcotic).
France maintains strict prohibitions on psilocybin with no current medical or decriminalization programs.
BE Belgium Illegal
Illegal for all purposes.
Unlike the Netherlands, Belgium maintains strict prohibition of magic mushrooms and truffles.
PL Poland Illegal
Illegal. Psilocybin and psilocin are Schedule I.
Poland strictly criminalizes psilocybin with no medical use provisions.
US United States Illegal
Federally illegal (Schedule I). However, therapeutic use legal in OR, CO. Decriminalized in several cities.

AR Argentina Illegal
Illegal for all purposes.
Despite medical cannabis progress, Argentina maintains strict laws against psilocybin.
PE Peru Illegal
Officially illegal, but practically enforcement against traditional or personal use is non-existent.
Peru heavily protects Ayahuasca as cultural heritage. While mushrooms do not share formal protection, the state virtually ignores possession.
NZ New Zealand Illegal
Class A scheduled drug. Extremely strict penalties.
New Zealand classes psilocybin mushrooms in the strictest safety category.
ZA South Africa Illegal
Illegal for all purposes.
While South Africa legalized private cannabis use, this did not apply to other substances.
IL Israel Illegal
Illegal. Medical trials ongoing but no general medical access.
Israel is actively conducting clinical trials for psilocybin and MDMA therapy, but these remain experimental.
JP Japan Illegal
Illegal and strictly enforced since 2002.
Prior to 2002, "magic mushrooms" were legally sold in Japanese headshops because the law only banned the extracted chemical. The law was amended to ban the mushrooms entirely.
SG Singapore Illegal
Class A scheduled drug. Exceptionally harsh penalties.
Singapore maintains a zero tolerance policy for all psychoactive substances.
CA Canada Medical Only
Illegal recreationally, but grey-market dispensaries operate openly. Medical access via SAP.
Special Access Program (SAP) allows doctors to request psilocybin for patients with serious conditions. BC's temporary decriminalization pilot (2023â2024) has ended. Grey-market dispensaries continue to operate.
AU Australia Medical Only
Since July 2023, authorized psychiatrists can prescribe psilocybin for treatment-resistant depression.
Australia became the first country to officially classify psilocybin as a medicine at a national level (Schedule 8).
AT Austria Decriminalized
Personal use decriminalized. Cultivation legal until fruiting bodies form.
Austria has a unique loophole where growing mycelium is legal. The act of fruiting crosses into illegality.
NL Netherlands Decriminalized
"Magic mushrooms" banned in 2008, but "Magic truffles" (sclerotia) remain legal and are sold openly.
The 2008 ban specifically targeted the fruiting bodies of mushrooms. Sclerotia (truffles), grow kits, and spores were excluded.
ES Spain Decriminalized
Private personal use is an administrative offense. Grow kits sold legally.
Spain's drug laws focus on public order. Private consumption/cultivation are protected by privacy rights.
PT Portugal Decriminalized
Decriminalized for personal use under 2001 reform.
Fully integrated into Portugal's 2001 drug decriminalization model. No criminal record for small quantities.
IT Italy Decriminalized
Personal use is an administrative offense, not a criminal one.
Italy treats personal possession of all drugs as an administrative rather than criminal violation.
CZ Czech Republic Decriminalized
Possession for personal use is a misdemeanor (fine).
Czechia has some of the most liberal drug policies in Central Europe regarding minor personal possession.
MX Mexico Decriminalized
Cultivation and use technically illegal but legally protected for indigenous traditional/sacramental use.
Article 195 bis of the Penal Code specifically exempts traditional botanical entheogen use from prosecution.
BR Brazil Decriminalized
Psilocybin is fully illegal, but the actual fungi (Psilocybe) are not explicitly banned on the scheduled plants list.
Anvisa Portaria 344/98 lists psilocybin as illegal, but omits the mushroom species from its prohibited list (unlike Coca or Cannabis).
CO Colombia Decriminalized
Personal possession decriminalized under 1994 Constitutional Court ruling.
Colombia applies constitutional protection to all drugs for personal, non-commercial use.
